TERMS OF SERVICE

Last Updated: August 16, 2026

1. Overview & Acceptance of Terms

Welcome to SilverRushRareFinds – Fine Antique Silver Sales & Rental.

Throughout this website, the terms “we,” “us,” “our,” and “the Store” refer to SilverRushRareFinds, as applicable. The terms “you” and “your” refer to visitors, customers, and users of this website.

This online store is operated using the Shopify platform.

By accessing this website, placing an order, or using our services, you agree to these Terms of Service and the applicable policies referenced below.

Please read these Terms before using our website or completing a purchase.

Nothing in these Terms is intended to exclude, restrict, or override any mandatory consumer right or remedy that cannot legally be waived or limited.

2. Related Store Policies

These Terms should be read together with our other applicable policies, including:

  • Shop Policies & Legal Notice

  • Return & Refund Policy

  • Shipping Policy

  • Privacy Policy

  • Rental Policy, where applicable

  • any specific terms stated in an individual product or service listing.

These policies form part of the terms governing transactions with our Store to the extent applicable.

For a particular product, the specific information contained in its individual listing—including its age, condition, measurements, weight, materials, hallmarks, and other characteristics—takes precedence over general product descriptions contained in our Shop Policies.

If any provision of these Terms or our policies conflicts with mandatory applicable consumer law, the mandatory legal requirement will prevail to the extent of that conflict.

3. Use of Our Website

You may use this website only for lawful purposes.

You must not use the website or our services to:

  • engage in fraudulent, deceptive, unlawful, or abusive activity;

  • provide materially false or misleading information;

  • interfere with the security or operation of the website;

  • transmit viruses, malicious code, or harmful technology;

  • attempt unauthorized access to our systems or other users' information;

  • infringe intellectual property or other legal rights; or

  • reproduce, scrape, systematically collect, or commercially exploit our website content without authorization where prohibited by law.

We may reasonably restrict or terminate access where necessary to protect our Store, customers, systems, or third parties, subject to applicable law.

4. Products, Orders & Availability

Our Store specializes in antique and vintage silverware, and many items are unique or one-of-a-kind.

Submitting an order constitutes an offer to purchase. An automated order confirmation confirms receipt of the order but does not necessarily constitute final acceptance.

We may reasonably decline or cancel an order before fulfillment where:

  • an item is unavailable;

  • an obvious material pricing or listing error has occurred;

  • payment cannot be authorized or verified;

  • required customer or delivery information is incomplete;

  • we reasonably suspect fraud or unauthorized payment;

  • shipment to the destination is unavailable or legally restricted; or

  • completing the transaction would violate applicable law.

If we cancel an order after payment has been collected, the amount paid for the cancelled item or order will be refunded using the original payment method where reasonably possible.

Because many antique and vintage items are unique, an identical replacement may not be available.

Detailed information concerning product age, condition, hallmarks, attribution, photographs, measurements, and other characteristics is provided in the individual listing and our Shop Policies & Legal Notice.

5. Prices, Payment & Errors

Prices are displayed in the currency indicated on the website or at checkout.

Available payment methods are those displayed through our Shopify checkout and may vary by customer location, currency, device, and payment services enabled by the Store.

Customers are responsible for reviewing their order information, shipping address, and payment details before submitting an order.

We make reasonable efforts to ensure that prices and product information are accurate. However, occasional typographical, technical, pricing, or publishing errors may occur.

If an obvious material error is discovered before fulfillment, we may correct it and, where appropriate, offer the customer the opportunity to proceed on the corrected terms or cancel the affected order.

Nothing in this section limits rights available under applicable consumer law.

International customs duties, import taxes, VAT, brokerage fees, and related charges are governed by our Shop Policies & Legal Notice and applicable law.

6. Shipping, Returns & Refunds

Shipping, delivery, packaging, customs procedures, shipping damage, returns, exchanges, cancellations, and refunds are governed by our:

Shop Policies & Legal Notice, Shipping Policy, and Return & Refund Policy.

Customers should review these policies before completing a purchase.

Where applicable law provides mandatory cancellation, withdrawal, return, refund, warranty, or other consumer rights, those rights will be respected regardless of anything in these Terms.

7. Intellectual Property

Unless otherwise stated, original content created for this website—including product photographs, written descriptions, graphics, logos, branding, articles, guides, and other original materials—is owned by or licensed to the Store and is protected by applicable intellectual property law.

Website content may be viewed for personal, non-commercial shopping and informational purposes.

Except as permitted by applicable law, you may not reproduce, republish, distribute, sell, systematically download, or commercially exploit our original content without permission.

Third-party trademarks, historical manufacturer names, maker names, hallmark references, and other third-party intellectual property remain the property of their respective owners. Their use on this website is for identification, description, historical reference, or other lawful purposes and does not imply sponsorship or endorsement.

8. Third-Party Services

Our website relies on third-party services that may include Shopify, payment processors, shipping carriers, analytics providers, and other service providers.

These third parties may have their own terms, policies, and privacy practices.

We are not responsible for the independent acts, content, policies, or availability of third-party services outside our reasonable control.

Links to third-party websites are provided where useful and do not necessarily constitute endorsement.

9. Website Availability & Limitation of Liability

We make reasonable efforts to maintain an accurate, secure, and functional website but cannot guarantee that the website will always be uninterrupted, error-free, or continuously available.

We may update, modify, suspend, or discontinue website features, content, products, or services from time to time.

To the maximum extent permitted by applicable law, we are not responsible for indirect, incidental, special, or consequential loss resulting solely from circumstances outside our reasonable control or from misuse of products contrary to disclosed instructions or their reasonably intended nature.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, mandatory consumer rights, or any other liability that applicable law does not permit us to exclude or limit.

10. Privacy

Our collection, use, disclosure, retention, and protection of personal information are governed by our Privacy Policy and applicable privacy law.

Personal information necessary to process orders and operate the Store may be processed by us and by service providers such as Shopify, payment processors, and shipping providers as further described in our Privacy Policy.

Please review our Privacy Policy for further information.

11. Rental Services

Where antique or vintage silverware is offered for rental, the transaction may be subject to a separate Rental Policy, Rental Agreement, deposit terms, or other rental-specific conditions.

Those terms may address rental periods, deposits, delivery and collection, cleaning, loss, damage, late returns, and responsibility for rented property.

Rental-specific terms supplement these Terms of Service. Where there is an inconsistency concerning a rental transaction, the specific Rental Agreement or Rental Policy will govern that matter, subject to mandatory applicable law.

12. Governing Law & Mandatory Consumer Rights

Subject to mandatory consumer protection laws applicable to a customer's jurisdiction, these Terms and transactions with our Store are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.

Nothing in these Terms is intended to deprive a consumer of statutory rights, protections, or remedies that cannot legally be waived or limited.

These Terms do not require consumers to submit disputes to mandatory arbitration or waive rights to participate in proceedings where such contractual restrictions are prohibited by applicable law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue to apply to the extent permitted by law.

13. Changes & Contact Information

We may update these Terms from time to time to reflect changes in our business, website, services, technology, or applicable legal requirements.

The current version will be published on this website with an updated revision date where appropriate.

Changes will not retroactively remove mandatory consumer rights or alter completed transactions where prohibited by applicable law.

Questions regarding these Terms, our products, or an order may be submitted using the contact information provided on our website.

Mandatory Consumer Rights

Nothing in these Terms of Service excludes, restricts, waives, or replaces any statutory warranty, cancellation right, withdrawal right, refund right, consumer protection, or other remedy that cannot legally be excluded or limited.

Where these Terms conflict with a mandatory requirement of applicable law, the mandatory legal requirement will prevail to the extent of that conflict.
